KOTA KINABALU: For brutally raping, abducting and assaulting a Universiti Malaysia Sabah (UMS) student, Mohd Sahrizal bin Suhaili, 21, and Mohd Ariffin Bidin, 29 will languish in jail for the next three decades and whipped repeatedly.
Mohd Ariffin of Kg Tarap Bongawan was sentenced to a total of 56 years in jail, ordered to be given 25 strokes of the cane and fined RM1,000 in default five months’ imprisonment. Mohd Sahrizal of Kg Pirasan Kota Belud was ordered to spend a total of 35 years in jail, whipped 20 times and told to pay a fine of RM1,000 or spend another five months in prison.
However, Sessions Court Judge, Duncan Sikodol ordered their sentences to run concurrently. Both men pleaded guilty to the charges in the Sessions Court here yesterday.
Earlier, they were also convicted on several charges of auto theft at the Magistrate’s Court and sentenced to prison for a total of six years. The older rapist was convicted on two charges of rape and jailed 23 years and ordered to be whipped 10 times for each offence. Mohd Sahrizal was convicted on one charge of rape for which he was given 20 years in prison and 10 strokes of the cane. His second offence was forcing unlawful sex on the victim for which he received 15 years’ imprisonment and ordered to be whipped five times.
Their rape charges were framed under Section 376 (2) of the Penal Code while Sahrizal’s second charge was under 377C of the same Code. For aggravated assault, they were each jailed five years and whipped five times in accordance with Section 325 of the Penal Code read together with Section 34 of the same code.
Their abduction charge was punishable under Section 365 of the Penal Code read with Section 34 of the same Code. The offence landed each of them five years in jail and a fine of RM1,000 in default five months’ imprisonment. When asked by Judge Duncan why they committed such heinous acts, both men claimed they were under the heavy influence of drugs and alcohol.
On April 15, they abducted a 22-year-old UMS female student from the Kingfisher Park area here at about 6.50pm and subjected her to rape and assault during a terror ride to Tambunan. Her ordeal lasted until the following day when she was rescued by police after a high-speed car chase along the Tambunan-Kota Kinabalu road.
Mohd Sahrizal was arrested first and Mohd Ariffin the next day on April 17. Earlier at the Magistrate’s Court yesterday, the duo were sentenced to 20 months in jail and fined RM5,000 in default four months’ imprisonment for stealing a Kancil car belonging to one Zainal bin Tahir at Jalan Pantai in the city between March 2 to 3. They were also convicted of stealing another Kancil car that belonged to Florita @ Nurul Awatif at Taman Bukit Setia along Sepanggar Road on February 6.
For the offence, they were jailed 36 months and told to pay RM5,000 or spend another 10 months in jail. Both Mohd Ariffin and Mohd Sahrizal were also ordered to be placed under police supervision for 12 months.
Mohd Ariffin will have to spend another 15 months in jail and pay up RM5,000 or languish another four months in prison for stealing a car that belonged to Voo Tze Hiung at Taman Puri Wawasan in Inanam on September 27 last year. Magistrate Marlina Ibrahim presided over the cases.
